For purposes of this agreement, “PARR” means Parr Lumber Company.

1. Voluntary Participation & Eligibility

I am at least 18 years old and voluntarily choose to participate in the event identified above. I understand that I may decline an activity or stop participating at any time.

I will not operate tools or participate in an activity if illness, fatigue, impairment, medication, or another condition affects my ability to do so safely. I will ask event staff for assistance or an accommodation before participating if needed.

2. Acknowledgment & Assumption of Risk

I understand that the activities identified above involve risks associated with hand tools, power tools, sharp edges, moving parts, building materials, dust, noise, electricity, and flying debris.

These risks include cuts, punctures, splinters, burns, eye injuries, hearing damage, respiratory irritation, strains, crushing injuries, amputations, electric shock, slips, trips, and falls. Accidents may cause property damage, serious injury, permanent disability, or death.

Injuries may result from contact with tools or materials, kickback, equipment malfunction, material failure, or the actions of other participants. Instruction and protective equipment cannot eliminate every risk.

I understand these risks and the additional risks identified above. I voluntarily assume the risks associated with my participation, subject to the limitations in Section 5. This assumption of risk does not apply to claims that applicable law prohibits me from waiving.

3. Safety Requirements

I agree to:

  • Complete required safety instruction before using tools.
  • Use only tools and equipment authorized by event staff, in the manner instructed and with required supervision.
  • Wear required protective equipment and appropriate clothing and footwear.
  • Secure loose clothing, jewelry, and long hair.
  • Keep guards and safety devices in place and never bypass them.
  • Maintain a safe distance from others and avoid distractions or horseplay.
  • Stop immediately and notify staff if equipment appears damaged, malfunctions, or creates a safety concern.
  • Ask for assistance whenever I do not understand an instruction or feel uncertain about an activity.
  • Follow staff directions to stop work or leave an activity.

PARR may restrict or end my participation for unsafe conduct or failure to follow instructions. These requirements do not transfer PARR’s legal duties to me.

4. Release of Claims for Ordinary Negligence

In consideration of being permitted to participate, and only to the extent permitted by applicable law and subject to Section 5, I release the PARR from my claims for bodily injury, death, or property damage arising from my participation in the identified activities and the risks described in this agreement.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS CAUSED IN WHOLE OR IN PART BY PARR’S ORDINARY NEGLIGENCE. ORDINARY NEGLIGENCE MEANS A FAILURE TO EXERCISE REASONABLE CARE.

I understand that, where enforceable, this provision prevents me from recovering damages for those released claims even if PARR’s ordinary negligence contributed to my injury or loss.

5. Hold Harmless & Participant-Caused Claims

To the fullest extent permitted by applicable law, I agree to hold harmless, indemnify, and defend PARR from and against third-party claims, demands, damages, losses, liabilities, judgments, settlements, costs, and reasonable attorneys’ fees arising out of or relating to my own acts or omissions, my failure to follow safety instructions, my misuse of tools, equipment, materials, or facilities, or my damage to property during the event.

This hold harmless obligation does not require me to indemnify, defend, reimburse, or pay PARR for PARR’s sole negligence, gross negligence, reckless conduct, willful misconduct, intentional wrongdoing, negligence per se, or any other claim or liability that applicable Washington or Oregon law prohibits from shifting to me.

For Washington events involving construction, alteration, repair, improvement, maintenance, or similar work on real property, this provision applies only to the extent permitted by RCW 4.24.115, including any requirement that indemnity for concurrent negligence be specific, express, and limited to the extent of my fault.

For Oregon events, this provision is subject to the Oregon limitations in Section 6 and does not apply to claims that Oregon law makes nonwaivable or nonindemnifiable.

6. Claims Not Released & State-Specific Limits

Nothing in this agreement releases claims for gross negligence, reckless conduct, willful misconduct, intentional wrongdoing, or any liability that applicable law prohibits from being released.

For Oregon Events: To the extent Oregon Laws 2026, Chapter 132 (SB 1517), applies, this agreement also does not release:

  • Claims for negligence per se.
  • Claims relating to the maintenance or inspection of safety equipment supplied by the operator and used in the activity.
  • Claims relating to negligent safety-related training of an operator’s employee or agent whose conduct causes injury.
  • Claims relating to abuse as defined in ORS 419B.005, or physical or sexual assault of an adult.
  • Claims relating to negligent hiring, training, credentialing, supervision, or retention of an employee or agent whose injury-causing conduct constitutes gross negligence, reckless conduct, willful misconduct, or an intentional tort.
  • Claims relating to vehicle operation or use, including transportation to or from the activity, except to the extent the statute permits a release for a participant’s use of a vehicle as part of the activity itself.

For Washington Events: This agreement does not release claims that Washington law makes nonwaivable or for which enforcement would violate public policy.

These limitations apply to every provision of this agreement. No provision requires reimbursement, indemnification, or payment of PARR’s legal expenses for a claim excluded from this release.

7. Medical Assistance

If I require emergency assistance and cannot provide consent, I authorize event personnel to contact emergency responders and arrange appropriate assistance.

I understand that medical providers may bill me for services. This authorization does not waive any claim preserved under Section 5 or determine who is ultimately legally responsible for those expenses.

8. Applicable Law & Severability

This agreement is governed by the law of the state where the event takes place, subject to any mandatory applicable law.

If a provision is unenforceable, it will be severed or limited only as legally permitted. The remaining provisions will remain effective to the extent permitted by law. No provision will be interpreted to expand this release beyond lawful limits.

9. Participant Acknowledgment & Signature

I have read this agreement, including the event description, risks, release of ordinary-negligence claims, and exceptions. I have had sufficient time to review it and an opportunity to ask questions. I understand that signing affects my legal rights.
